You own a business. One of your key employees just gave notice that she is resigning, effective immediately.

  • You know she had access to a great deal of your highly confidential information.
  • Your manufacturing data and formulas, financial information, customer lists, R&D data and know-how are all at risk.
  • You believe she has already agreed to join your fiercest competitor.

Your attorney asks some important questions:

  • Did your employee sign a confidentiality agreement? Sadly, you say no.
  • Was any of the sensitive information labeled as “confidential” or was access restricted to only those who have a need to know? You answer that it was not – that everyone “understood” what was confidential.
