Alison P. Buchanan to Speak at LMRM Conference

Hoge Fenton shareholder Alison P. Buchanan will speak on a panel “The Perils of Multijurisdictional and Cross-Border Practice,” presented at this year’s Legal Malpractice & Risk Management Conference in Chicago, Illinois. This panel is eligible for ethics CLE credit.

This panel will include an exploration of the issues facing lawyers whose practices reach, to varying degrees, beyond the states or countries where they are licensed to practice. Six states currently do not permit temporary practice at all; others, like New Jersey, recently have had numerous issues develop over their restrictions on out-of-state lawyers. The panel will canvass the lay of the land in the United States and then turn to the consequences of the current rules for attorneys in modern practice. Particular attention will be paid to developments in technology — such as remote access — that make current regulations appear obsolete, even though they continue to govern. Finally, the panel will examine the prevalence of virtual law offices and other nontraditional law firm structures with regard to their potential for causing unintended violations of state ethics rules and laws.

Alison P. Buchanan is a regular and sought-after speaker and teacher on the topics of professional liability/professional malpractice and legal ethics. From 2011 through 2014, Alison served a three-year appointment to the California State Bar’s Standing Committee on Professional Responsibility and Conduct (COPRAC). She serves on the Executive Committee of The Bar Association of San Francisco’s Legal Malpractice Section, chairs the Professionalism Committee for the Santa Clara County Bar Association, and teaches Professional Responsibility at Lincoln Law School in San Jose.
