Alison’s panel will explore the intricacies of the attorney-client privilege and the more complicated issues that arise relating to it. Topics include:

  • When must you assert the privilege on behalf of a client?
  • What constitutes waiver?
  • What if your client lacks capacity to evaluate whether to waive?
  • Who holds the privilege for a dissolved corporation or a deceased client?
