Dollars and Dirt: Real Estate Damages

This seminar is a must for every practitioner whose clients buy, sell or rent real property. Presenters, Dan Ballesteros and Brian Cadieux, will provide the perspectives of appraisers and litigators.

Presenters will discuss the ABCs of Real Estate Damages, including:

  • the legal basis for the recovery of damages,
  • types of recoverable damages,
  •  the “Bell Chart” and how to use it to support or attack expert’s valuations.

The seminar will also cover certain kinds of costs and their impact on value, including:

  • the cost to repair,
  • betterment,
  •  functional obsolescence.

Seminar participants will also learn about the importance persuasive market data.

The presenters, from their perspectives of appraisers and litigators, will discuss the differences between the benefit of the bargain and out of pocket measures and explain the meaning of diminution given the recent downturn. They will also discuss the concept of stigma and its recoverability.
