Practice Overview

Colleen B. Kelley is an associate in the firm’s San Jose Office, where she focuses on all aspects of civil litigation.

Ms. Kelley’s practice emphasis is on general business and real estate litigation, advocating for her clients in matters involving such issues as breach of contract, fraud, breach of fiduciary duty, and negligence.  She also practices collections law and has done pro bono work re: violations of the Fair Debt Collections Act.

Representative Matters

  • Defense of owner of historic property against suit brought by a municipality to compel retrofitting

  • Representation of a real estate developer in an attorneys’
    fees arbitration hearing

  • At a one-day trial, obtained favorable judgment in excess of limited jurisdiction of the court

  • Negotiated favorable settlement on behalf of lender client in a suit involving alleged breach of contract

  • Negotiated multiple favorable settlements in mediation regarding real estate transactions

Professional Activities

Ms. Kelley has externed at the California Court of Appeal, First Appellate District (Justice T. Reardon), worked as a Congressional Aide for U.S. Representative Zoe Lofgren, and conducted research for a Hastings professor for a nationally published law review article and textbook. She also has participated as a coach for the Lincoln High School Mock Trial Team.

Ms. Kelley is a recipient of the CALI Award for Excellence in Community Property, and Honorable Mention for Best Brief and Best Oral Argument in Moot Court. She is also an active member of the Santa Clara County Bar Association.
