Hoge Fenton Attorney Provides Statement on Recently Filed Civil Complaint

Hoge, Fenton, Jones &  Appel, Inc., today announced that Barbara Spector, an attorney with the firm who is representing the victim in the De Anza Rape case, filed a civil complaint in Santa Clara County Superior Court.  Upon filing, Ms. Spector made the following statement:
           
“In March of last year, my client was the victim of what Santa Clara County Sheriff Laurie Smith called a ‘sexual assault.’ An investigation was conducted by the Santa Clara County Sheriff’s department, which concluded that a crime had occurred.

However, in May 2007, Santa Clara County District Attorney Dolores Carr determined that there was insufficient evidence to prosecute. Thereafter, the district attorney requested a review by the State Attorney General’s Office. That criminal investigation ensued and is ongoing.

Even though the criminal investigation is not completed, we were required to file a civil complaint because of the legal requirements imposed by statutes of limitation.

Our client remains fully prepared to cooperate with the Attorney General’s office in its investigation and in any future prosecution.”
